Abstract

يتناول هذا البحث بالدراسة منهج فقهاء الإباضية من خلال أحد أعلامهم المعاصرين وهو الشيخ اطفيش رحمه الله في التعامل مع كتب الحديث المشهورة وهي صحيح مسلم والسنن الأربعة من حيث مدى الاستعانة بها في مباحث الفقه ومسائله وكذا أوجه الاستفادة منها استدلالا وترجيحا ونقدا، حيث أبرزت الدراسة أن تلك المصادر كان لها حضور واسع، وكانت عمدة الكثير من آراء الإباضية الفقهية مع بعض النقد لها أحيانا من حيث الأسانيد أو ترجيح ما هو أقوى منها سواء من نصوص القرآن الكريم أو الأحاديث النبوية، وهذا يبرز سعة الأفق في الفكر الإباضي ووسطيته واعتداله في الأخذ بتراث المسلمين جميعا، بغض النظر عن الاختلاف المذهبي. This research examines the methodology of Ibadi jurists through one of their contemporary scholars, Sheikh Atfayish, may God have mercy on him, in dealing with the famous books of Hadith, namely Sahih Muslim and the four Sunan, in terms of the extent of their use in the discussions of jurisprudence and its issues, as well as the ways of benefiting from them in terms of evidence, preference and criticism. The study highlighted that these sources had a wide presence and were the basis for many of the Ibadi jurisprudential opinions, with some criticism of them at times in terms of chains of transmission or preference for what is stronger than them, whether from the texts of the Holy Qur'an or the Prophetic Hadiths. This highlights the breadth of vision in Ibadi thought and its moderation and balance in taking the heritage of all Muslims, regardless of the doctrinal differences.
