المسائل الفقهية المختلف في القول المعتمد فيها بين ابن الحاجب وخليل في مختصريهما دراسة تأصيلية تطبيقية

Abstract

يتناول البحث كثرة الأقوال والروايات في المذهب المالكي وما سبّبته من صعوبة في تحديد المعتمد منها، مما دفع الفقهاء إلى تمحيص أقوال مالك بن أنس وتلاميذه، والتمييز بين الراجح والضعيف والمشهور والشاذ. ثم جاء دور جمع هذه الأقوال وتنظيمها لتيسير العمل بها، وكان من أبرز ذلك جهد ابن الحاجب في كتابه جامع الأمهات. وبعده خالفه خليل بن إسحاق الجندي في بعض الاختيارات في مختصر خليل. وتركّز الدراسة على تتبّع هذه الخلافات، وتحليل أدلتها، وبيان منهج كل منهما في الترجيح، بهدف الوصول إلى القول الأرجح في المذهب. This study examines the abundance of juristic opinions and narrations within the Maliki school, which has led to difficulty in identifying its authoritative positions. As a result, Maliki scholars devoted their efforts to scrutinizing the narrations of Malik ibn Anas and the views of his students, distinguishing between strong and weak, as well as well-known and anomalous opinions. Later, scholars worked on compiling and organizing the relied-upon positions to facilitate their use, most notably Ibn al-Hajib in his book Jāmiʿ al-Ummahāt. Subsequently, Khalil ibn Ishaq al-Jundi differed with him in some selected opinions in Mukhtasar Khalil. The study focuses on tracing these differences, analyzing their evidences, and clarifying the methodological approaches of both scholars in weighing opinions, with the aim of determining the most accurate view within the Maliki school.
