Abstract

تتمحور هذه الدراسة حول ظاهرة "العدول الاجتهادي" عند الإمام مالك بن أنس، حيث تتقصى المسائل الفقهية التي غير فيها الإمام رأيه، معتمدةً على استقراء دقيق لمصادر المذهب الأم (الموطأ والمدونة) لاستنباط الأقوال التي استقر عليها العمل في الفتوى والقضاء. وتستهل الدراسة برصد تاريخي لتدوين هذه الأقوال وطرق نقلها، ثم تنتقل لتؤصل نظرياً لمفهوم "التراجعات" والفرق بينها وبين المصطلحات المشابهة كالنسخ والتخصيص، مع وضع ضوابط دقيقة لمعرفة المسلك الذي سلكه الإمام في تراجعه. وتبرز الدراسة الأسباب الموضوعية لهذا التغير، سواء كانت أسباباً حديثية (كظفر الإمام بحديث لم يبلغه من قبل)، أو أصولية (كتغير مناط الحكم أو إعمال سد الذرائع)، أو مصلحية تراعي تغير الزمان والمكان. كما تُفصل المذكرة في الآثار المترتبة على هذه التراجعات داخل المدرسة المالكية، وكيف أدت إلى ظاهرة تعدد الروايات والأقوال، مع تقديم نماذج تطبيقية معمقة في أبواب العبادات والمعاملات توضح كيف أن رجوع الإمام عن قوله لم يكن اضطراباً بل كان تعميقاً للاجتهاد وجرياً على أصول المذهب وقواعده الكلية، مما يجعل من هذا البحث مرجعاً مهماً لفهم مرونة الفقه المالكي ومنهجية الترجيح بين الأقوال المروية عن إمام دار الهجرة. This comprehensive study investigates the phenomenon of "Juridical Retractions" (Al-Taraju'at) within the Maliki school, specifically focusing on cases where Imam Malik revised his earlier legal opinions. The research aims to distinguish between the Imam's initial views and his final, settled positions to provide a definitive framework for Fatwa and Judiciary. It begins with a historical analysis of how these opinions were documented in Al-Muwatta and Al-Mudawana, examining the roles of his disciples in transmitting and refining these texts. Theoretically, the study establishes rigorous criteria for identifying retractions and explores their underlying causes, such as the emergence of stronger prophetic evidence, shifts in legal analogy (Qiyas), or the application of "Sadd al-Dhara’i" (blocking the means to evil). Furthermore, it addresses the legal authority of these retractions for both "Muftis" and "Judges" and explains how this intellectual flexibility led to the healthy diversity of narrations within the doctrine. Through a practical survey of issues in Worship (Ibadat) and Transactions (Mu'amalat), the study proves that Imam Malik’s retractions were not inconsistencies but rather a rigorous adherence to evolving evidence and the core principles of his school, ultimately offering a methodological roadmap for contemporary scholars to navigate the Maliki heritage with precision.
