Applied ijtihād (ijtihād al-tanzīl) enables the judge to broaden the scope of judicial consideration in disputes and litigation, ensuring that rulings are anchored in the balance of the Sharīʿah and its governing principles. It grants the judge wide latitude through the consideration of consequences (maʾālāt), the blocking of means (sadd al-dharāʾiʿ), the prevention of legal stratagems (ḥiyal), attention to the objectives of the Lawgiver (maqāṣid al-shāriʿ), the intentions of legally responsible agents, as well as prevailing customs and factual circumstances—thereby safeguarding judicial decisions from personal inclinations and from the erosion of rights. Judicial rulings are therefore more particularized than both ijtihād and fatwā, for the judge examines the same specific matters considered by the muftī and the jurist, yet with additional verification of causes and intents and with the removal of countervailing factors.
