http://dspace.univ-emir-constantine.edu.dz/jspui/handle/123456789/114 2026-04-02T06:04:08Z http://dspace.univ-emir-constantine.edu.dz/jspui/handle/123456789/3125 Titre: Purity issues criticized by Ibn al-Fakhar al-Qurtubi on Ibn Abi Zaid al-Qayrawani through his insightful treatise on the criticism of Ibn Abi Zayd al-Qayrawani’s message مسائل الطهارة التي انتقدها ابن الفخار القرطبي على ابن أبي زيد القيرواني من خلال رسالته التبصرة في نقد رسالة ابن أبي زيد القيرواني Auteur(s): شوال, حكيم Résumé: يدور هذا البحث حول مسائل فقهية خاصة بباب الطهارة، انتقدها ابن الفخّار القرطبي على ابن أبي زيد القيرواني من خلال كتابه الرسالة، وذلك في رسالة صغيرة الحجم سمّاها "التبصرة في نقد رسالة ابن أبي زيد القيرواني"، وهذه الانتقادات حاصلها سبعة عشر مسألة رآه فيها جانب الصواب وحاد عن مذهب مالك، فجاءت هذه الدراسة لتناول المسائل الخاصة بباب الطهارة مقارنة بمذهب المالكية بغية الوصول إلى نتيجة يُحكَم من خلالها على أيّهما أسعد بمذهب مالك، أو بعبارة أخرى: هل ابن الفخّار محقّ في ردّه أو لا ؟، وقد توصّلت الدراسة إلى أنّ ابن الفخّار لم يكن محقّا في ردّه، بل تعسّف مع ابن أبي زيد القيرواني كما وصفه القاضي عياض بذلك. This research revolves around jurisprudential issues related to the chapter on purity, criticized by Ibn al-Fakhar al-Qurtubi on Ibn Abi Zaid al-Qayrawani through his book al-Risala, in a small letter he called "The Insight in Criticizing the Message of Ibn Abi Zayd al-Qayrawani", and these criticisms resulted in seventeen issues in which he saw one side The truth is deviating from the Malik school of thought, so this study came to address the issues related to the chapter of purity compared to the Maliki school of thought in order to reach a conclusion through which one is judged on which of them is happier according to the school of Malik, or in other words: Is Ibn al-Fukhar right in his response or not?, The study concluded that Ibn Al-Fukhar was not right in his response, but he was arbitrary with Ibn Abi Zaid Al-Qayrawani, as Judge Ayyad described it. This study aims to highlight the role of modern financial technology in the development of Islamic waqf and increase its developmental role, in order to succeed in presenting its programs and projects in more effective ways. The research drew on the quadrennial division of financial technology sectors chosen by the economic world "Dorflitner", where the moratorium was linked to four financial sectors: crowdfunding platforms, cloud computing, payments (block chain) and insurance technologies. In order to achieve these research objectives, the study relied on three core curricula: deductive, descriptive and Deductive. The research reached an important conclusion: the system's ability to interact positively with financial technological developments, as demonstrated by the waqf experiences mentioned in the research.
