Résumé: حرص فقهاء المذهب البقاء على نفس الأصول الفكرية التي قعدها الإمام مالك رحمه الله تعالى، لما حوى استعمالها من لطف وحلم ولين بالإنسانية جمعاء وسعي لبلوغ أسمى درجات الوسطية الإسلامية في كل أبواب الفقه، ورغم التشدد الذي عُرف على المذهب في باب المناكحات لخطورته حفظا على الأعراض والأنساب، غير أن الاجتهادات المالكية وجدت لكل معضلة حلا ولكل طارئ مخرجا حتى صارت هذه الاجتهادات ثروة يستأنس بها فقهاء المذاهب الأخرى وواضعوا النصوص القانونية في مجالات الأحوال الشخصية والمواريث والوصايا، ففيما تتجسد هذه الأصول الشرعية الفكرية التي استطاع فقهاء المذهب أن يوطنوا بها الوسطية في مذهبهم ؟ وإلى أي مدى كان تأثير هذا الفكر الرصين في اجتهادات المذاهب الأخرى والنصوص القانونية المنظمة لأحكام الزواج والطلاق وآثارهما ؟ The scholars of the Maliki school were keen to maintain the same intellectual principles established by Imam Malik, may God have mercy on him, because their application embodies gentleness, forbearance, and compassion towards all of humanity, and strives to reach the highest levels of Islamic moderation in all areas of jurisprudence. Despite the strictness for which the school is known in matters of marriage, due to its importance in preserving honor and lineage, Maliki jurisprudence has found a solution for every problem and a way out for every emergencyThese efforts became a wealth of knowledge that scholars of other schools of thought and drafters of legal texts in the areas of personal status, inheritance, and wills draw upon. In what ways are these intellectual and legal principles embodied, by which the scholars of the school of thought were able to establish moderation in their school of thought? And to what extent did this sound thought influence the efforts of other schools of thought and the legal texts regulating the provisions of marriage, divorce, and their effects?

Résumé: تعتبر الوسطية من محاسن الدين الإسلامي، وقد برع الإمام مالك في إبرازها من خلال اجتهاده وخصوصا بإعمال أصل مراعاة الخلاف، فأين تكمن مظاهر وسطيته في تطبيق هذه القاعدة الاجتهادية؟ وما آثارها في تحقيق التوافق والائتلاف؟ وتبرز أهمية هذه الورقة البحثية في أنّها تكشف عن منهج متكامل يجمع بين الانضباط بالنصوص والانفتاح على الاجتهاد، وبين احترام الخلاف المشروع والسعي إلى وحدة الأمة، وتهدف إلى إبراز ملامح الوسطية من خلال هذا الأصل المالكي وأثرها في التقريب بين المذاهب الفقهية في إطار من الاحترام والتكامل لا النزاع والتفرّق، ويحتمل البحث فرضيتين إحداهما أنّ أصل مراعاة الخلاف لا يتأسّس على مبدا الوسطية ولا أثر له في تخفيف الصراعات العلمية، والأخرى أنّه يرتكز على الوسطية من جهات متعددة، كما أنّه يُسهم في نشر الأخلاق الفاضلة بين المشتغلين بالعلم، وقد اعتمدتُ في هذه الدراسة المنهج الوصفي مستعينا بأداة التحليل، وقد توزّع على محورين: المحور الأول: تجليات الوسطية في أصل مراعاة الخلاف عند الإمام مالك -رحمه الله تعالى-. والمحور الثاني: آثار وسطية مالك من خلال إعماله لأصل مراعاة الخلاف في تحقيق التوافق والائتلاف. Moderation is one of the finest qualities of Islam, reflecting its balanced approach between adherence to principles and openness to ijtihād, as well as between ease and the removal of hardship. Imam Mālik ibn Anas (may Allah have mercy on him) exemplified this value through his juristic reasoning, particularly in his application of the principle of consideration of disagreement (murāʿāt al-khilāf), which reveals the breadth and depth of his legal thought.
This study addresses the central question: Where do the features of Imam Mālik’s moderation appear in his application of this juristic principle, and what are their effects in achieving harmony and unity among scholars and schools of law? The importance of this research lies in uncovering a comprehensive methodology that combines strict adherence to textual sources with openness to sound reasoning, respect for legitimate differences, and a sincere effort to preserve the unity of the Muslim community. It aims to highlight the manifestations of moderation in this Mālikī principle and its role in bridging the gap between legal schools within a framework of respect and complementarity rather than dispute and division.
The research is based on two main hypotheses: first, that the principle of considering disagreement is not inherently grounded in moderation and has little effect on reducing scholarly disputes; and second, that it is in fact rooted in various aspects of moderation and contributes to spreading ethical virtues among scholars and students of knowledge.
Using the descriptive-analytical method, the study is divided into two main sections:
1. The manifestations of moderation in Imam Mālik’s application of the principle of considering disagreement.
2. The effects of Mālik’s moderation, through this principle, in promoting harmony and unity.

Résumé: تمثل الوسطية إحدى خصائص الشريعة الإسلامية، التي تُعبّر عن العدل والاعتدال بين الإفراط والتفريط، وتُجسّد روح الشريعة القائمة على التيسير ورفع الحرج. وقد كانت هذه الخاصية مترجمة بوضوح في المذهب المالكي الذي تميّز بتوازنه في النظر والاجتهاد، إذ جمع بين الأصول النقلية والعقلية، ووازن بين النصوص الشرعية ومتطلبات الواقع، من خلال المصلحة والعرف وغيرهما، فكان منهجه تجسيدا عمليا لمفهوم الوسطية التي جعلها الله تعالى خصيصة لهذه الأمة في قوله: {وَكَذَلِكَ جَعَلْنَاكُمْ أُمَّةً وَسَطًا} [البقرة: 143].
لذا جاءت إشكالية البحث ملخصة في التساؤل التالي: ما هي مظاهر الوسطية في المذهب المالكي؟
ومن خلال هذه الإشكالية تظهر أهمية الموضوع المتمثلة في أنه يسعى لإبراز مظاهر الوسطية في المذهب المالكي، باعتباره مثالا حيا للوسطية الإسلامية، ولكون المالكية يحتفون بكون مذهبهم جمع بين المنصوص والمعقول، كان لزاما بيان أوجه ذلك حتى يستفيد المعاصرون من هذا المنهج في معالجة واقع الأمة المعيش.وتهدف هذه المداخلة إلى ما يلي: بيان مفهوم الوسطية، وبيان أهم أوجه ومظاهر الوسطية عند المالكية، ولتحقيق هذه الأهداف وضعت الفرضيات التالية:
• الوسطية عند المالكية ليست مجرد الوقوف في الوسط، بل منهج علمي متكامل مبني على تحقيق التوازن بين المنصوص والمعقول.
• المذهب المالكي جسد الوسطية من خلال الجمع بين التيسير والانضباط، والتوسع في المصلحة والعرف.
وللتحقق من صحة هذه الفرضيات اتبعت المنهج الوصفي التحليلي في عرض المفاهيم والنصوص، والمنهج الاستقرائي في تتبع التطبيقات الفقهية للوسطية في المذهب.
Moderation is one of the fundamental characteristics of Islamic law, expressing justice and balance between excess and negligence, and embodying the spirit of the Sharia, founded on ease, equilibrium, and the alleviation of hardship. This feature was clearly reflected in the Maliki school of jurisprudence, which is distinguished by its balanced approach to reasoning and ijtihad, combining traditional textual sources with rational principles and harmonizing legal texts with the practical requirements of reality through considerations of public interest (maslahah), custom (‘urf), and other contextual factors. Its methodology represents a practical embodiment of the concept of moderation that Allah Almighty has described as a distinctive trait of this community in His saying: “And thus We have made you a middle nation.”
The central research question is thus formulated as follows: What are the manifestations of moderation in the Maliki school of jurisprudence?
This question highlights the significance of the topic, which seeks to elucidate the manifestations of moderation within the Maliki tradition as a living example of Islamic balance and rationality. Given that the Maliki school is renowned for synthesizing textual authority and reasoned judgment, it becomes necessary to clarify these dimensions so that contemporary scholars may benefit from this approach in addressing the realities of Muslim societies.
This study aims to explain the concept of moderation and identify its principal aspects and manifestations in Maliki jurisprudence.
The following hypotheses are proposed:
• It is hypothesized that moderation in Maliki jurisprudence is not merely a position of being in the middle, but a comprehensive scholarly methodology founded upon achieving harmony between textual revelation and rational inference.
• It is further hypothesized that the Maliki school exemplifies moderation by combining facilitation with legal discipline, and by expanding its application of maslahah and ‘urf.
To verify these hypotheses, the study employs a descriptive and analytical method in presenting the conceptual framework and textual evidences, along with an inductive approach in tracing jurisprudential applications of moderation within the Maliki tradition.
Themes of the research:
